2025 Find Network – Terms of Use

  1. Electronic Signatures
    • This contract can be signed and witnessed electronically as allowed for by Sections 5 and 6 of the Electronic Transactions (Victoria) Act
  2. No reliance clause 
    • Each party acknowledges, it has not relied on any statement, representation, assurance or warranty other than as expressly set out in this agreement.

 

 

  1. Whole agreement 
    • The Applicant acknowledges that this agreement and these conditions contain the whole agreement between the parties and it has not relied upon any oral or written representations made to it by Find or its employees or agents and has made its own independent investigations into all matters relevant to the Find Network.

 

  1. Supersedes prior agreements 
    • This agreement supersedes any prior agreement between the parties whether written or oral and any prior agreements are cancelled as at the commencement date but without prejudice to any rights which have already accrued to either of the parties.

 

  1. Parties 
    • In this agreement unless the context otherwise indicates, a reference to a party includes that party’s executors, administrators, successors and permitted assigns.

 

  1. Reasonable Endeavours 
    • An obligation on a party to use “best endeavours” or “reasonable endeavours” is an obligation on that party to do all it reasonably can in the circumstances to achieve the contractual object, but no more.

 

  1. Governing Law 
    • This agreement and any dispute or claim arising out of, or in connection with, its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of Victoria, Australia.

 

  1. Severability
    • If any provision of this agreement is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from this agreement and rendered ineffective as far as possible without modifying the remaining provisions of this agreement and shall not in any way affect any other circumstances of or the validity or enforcement of this agreement.

 

  1. Jurisdiction 

The courts of Victoria, Australia, shall have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, this agreement, its subject
